Terms of service

These terms govern your use of the CropShareBox website and of the CropShareBox subscription service published by MLJ, SASU. They are written to be read by a working grower, not only by a lawyer.

1. Acceptance

By opening a CropShareBox account, by using the service, or by continuing to browse cropsharebox.com, you accept these terms on behalf of yourself and of the farm or organization you represent. If you do not accept them, do not use the service. Where a separate signed agreement exists between your organization and MLJ, SASU, that agreement takes precedence over anything written here that conflicts with it.

2. What the service is

CropShareBox is a web based planning tool for community supported agriculture. It lets a farm record what is available to harvest, compose weekly small and full share boxes against that availability, hold member preferences such as allergies, dislikes, vacation holds and add-ons, apply substitution rules when a crop falls short, print pack sheets and box labels sorted by pickup site and route, and send a weekly box preview to members by email or text message. It runs in a standard web browser and requires no installation.

CropShareBox is a planning and communication tool. It is not an accounting system, it does not sell shares, it does not take payments from your members, and it does not act as your agent with them. Any figure it produces is a calculation from the numbers you enter.

3. Accounts and eligibility

You must be at least eighteen years old and legally able to enter into a contract to open an account. You are responsible for the accuracy of the account details you provide, for keeping your credentials confidential, and for everything done under your account by your staff, your crew and your seasonal workers. Tell us promptly at jimenezjulien42@gmail.com if you believe an account has been used without your permission. You may create as many staff logins as your farm needs at no extra cost within your plan.

4. Acceptable use

You agree not to use CropShareBox to send unsolicited commercial messages to people who have not joined your CSA, to store data you have no right to hold, to attempt to gain access to another farm's account, to probe, scan or overload the infrastructure, to reverse engineer the service, or to resell access to it without written permission. We may suspend an account that is causing harm to the service or to other users, and we will tell you why in writing, in advance where circumstances allow.

5. Subscriptions and billing

Three plans are published: Small Share at $29 per month, Full Farm at $69 per month and Multi Farm at $139 per month. All prices are in United States dollars and exclude any tax that may apply to your situation. Every plan is billed monthly in advance from the date the subscription starts, and each payment covers the month that follows.

Plan limits are the ones described on the pricing section of the home page, principally the number of active member shares and pickup sites. If your farm grows past the limit of your plan during a season, we will contact you, move you to the plan that fits and prorate the difference on your next invoice. Prices may change for future billing periods with at least sixty days written notice, and any change is never applied in the middle of a season for an existing subscriber without written agreement.

6. Cancellation and refunds

You may cancel at any time from the account screen, with no notice period and no season minimum. Billing stops at the end of the current paid month and the service remains available until that date. We do not refund partial months, but we do not bill you again after cancellation. Many farms cancel in the fall and restart in the spring; when you do, your crops, members, notes and yield history are waiting for you. We may end a subscription for non payment after two written reminders, or for a serious breach of section 4.

7. Your data

Your member list, harvest records, box plans, notes and yield history remain the property of your farm at all times. We process them only to run the service for you and to provide support you have asked for. You can export everything to CSV at any moment without contacting us. After cancellation, your data is retained in a cold account for twelve months so a returning farm loses nothing, and it is deleted on request at any point before that. We never sell farm or member data, and we never use it to advertise to your members.

8. Availability and support

We aim for the service to be available at all times and we schedule maintenance outside the North American pack window wherever possible, which in practice means avoiding Tuesday and Wednesday mornings between April and November. We do not promise uninterrupted operation. Support is provided by email at jimenezjulien42@gmail.com with a target first response of one business day, and faults that block a pack day are treated as urgent and worked the same day.

9. Warranty disclaimer

The service is provided on an as is and as available basis. To the fullest extent permitted by law, MLJ, SASU disclaims all implied warranties, including fitness for a particular purpose, merchantability and non infringement. We do not warrant that the service will meet every requirement of your farm, that it will be free of errors, or that the harvest estimates you enter will match what your fields actually produce.

10. Limitation of liability

To the fullest extent permitted by law, the total liability of MLJ, SASU arising out of or relating to the service is limited to the amounts you paid for the subscription in the twelve months preceding the event giving rise to the claim. We are not liable for indirect or consequential loss, including lost share revenue, lost members, crop loss, spoilage, or the cost of buying in produce. Nothing in these terms excludes liability that cannot lawfully be excluded.

11. Indemnity

You agree to hold MLJ, SASU harmless from third party claims arising out of your use of the service in breach of these terms, out of content you upload, or out of your relationship with your own members, to the extent the claim is not caused by our own breach or negligence.

12. Changes to these terms

We may update these terms to reflect changes in the service or in the law. Subscribers are notified by email at least thirty days before a material change takes effect, and the date at the head of this page is updated. Continuing to use the service after that date means you accept the revised terms; if you do not, you may cancel without penalty.

13. Governing law and contact

These terms are governed by French law. Any dispute that cannot be settled amicably falls within the exclusive jurisdiction of the competent courts of Paris, France.
